Sexual Harassment

"Sexual Harassment” is defined as unwelcome sexual advances, requests for sexual favors, and other verbal or physical harassment of a sexual nature particularly when it explicitly or implicitly affects an individual's (male's or female's) employment, as well as when it interferes with an individual's performance in the workplace and/or creates a "hostile" work environment for the individual receiving unwanted sexually motivated attention.

Sexual harassment in the workplace is illegal under state and federal laws. The typical procedure for filing a sexual harassment claim or charge is as follows:

  1. Write it Down: Make sure to write down the details of the incident, list witnesses, and gather any physical evidence that could help your claim.

  2. Review  and familiarize yourself with the  company policies. Your employer should have processes and mechanisms in place that allow you to make a complaint through the human resources department of your company.

  3. Report to Supervisor: If harassment continues, after you have let the individual know the attention is offensive and unwecolmed, you must report
to your supervisor. If the harasser is your supervisor, report to someone higher or to the HR department. If the harasser is the highest-ranking individual in the workplace, report to the HR department or any other management personnel.

  4. File Complaint with EEOC: The first complaint you need to file is with the EEOC. The agency will investigate your claim and may take action with your employer to provide for your remedy

  5. File a Civil Complaint: If the EEOC does not resolve the issue, you may have to file a lawsuit in civil court. This will require you to provide evidence in support of your claim, such as written statements or witness testimony.

The New Tax Bill Passed by Congress

President Trump has taken credit for the newly passed tax bill passed by Congress in December 2017.  This bill is one of the most expansive tax reform bills in U.S. History.  The bill is full of tax breaks for the wealthy; the bulk of the content is the equivalent of corporate welfare or entitlements for the rich.  As suspected, the new law does not include relief for the poor.  The President has touted the bill as being beneficial to the middle class. However, many of the provisions that are expected to help middle class individuals are not as far reaching as the measures that were developed to help corporate America and the wealthy.

Pay close attention to the provisions that address the following elements as they might impact you:

  • student loans, interest rates, etc.l

  • loan forgiveness programs for teachers, doctors, nurses, etc.Medicare benefits

  • Social Security benefits

  • Health Care Premium Increases are likely and could impact your family or household

Ways to Access Legal Advice and Legal Representation

  • Many cities have free legal clinics that are staffed by attorneys who can provide legal advice.  Contact the Legal Aid Society in your area for information about Legal Clinics in your area.  You may be eligible  for free legal assistance and representation if you meet the income guidelines.

  • Many attorneys provide legal consultations with potential clients.  Often a retainer fee is required if the lawyer/firm agrees to represent as a client. You should check with the Bar Association in your area to inquire about the attorney or law firms rating.
